These Terms of Service (“Terms”) govern your access to and use of the website reflexiondigital.com (the “Site”) and the digital marketing services provided by Reflexion Digital LLC (“Reflexion Digital,” “we,” “us,” or “our”). By accessing the Site, submitting a form, opting in to our communications, or engaging our services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site or our services.
1. Use of the Site
You may use the Site only for lawful purposes. You agree not to interfere with the Site’s operation, attempt to gain unauthorized access to any systems, scrape or harvest data, or use the Site in any way that violates applicable law or these Terms.
2. Services
Reflexion Digital provides digital marketing services for ophthalmology and vision-correction practices, including but not limited to paid advertising management, content and video production, landing pages, email marketing, and marketing automation. Specific services, deliverables, fees, and timelines are defined in a separate written agreement, statement of work, or proposal between Reflexion Digital and each client. If a signed services agreement conflicts with these Terms, the services agreement controls for that engagement.
3. No Guarantee of Results
Marketing outcomes depend on many factors outside our control. Except as expressly stated in a signed services agreement, we do not guarantee specific rankings, lead volumes, consult volumes, revenue, or other results, and any performance figures on the Site describe past engagements and are not a promise of future performance.
4. SMS / Text Messaging Terms (A2P Program)
Reflexion Digital offers SMS/text-message communications for updates, scheduling, service notifications, and, where separately consented to, marketing messages.
- Consent & Opt-In: By providing your mobile phone number and opting in (for example, by submitting a form on this Site, texting a keyword, or giving written consent), you agree to receive text messages from Reflexion Digital at the number provided. Consent to receive text messages is not a condition of purchasing any goods or services.
- Message Frequency: Message frequency varies.
- Fees: Message and data rates may apply. Contact your wireless carrier with questions about your plan.
- Opt-Out: You can opt out at any time by replying STOP to any message. After you send STOP, we will send a final message confirming your unsubscription, and no further messages will be sent unless you re-subscribe.

- Eligibility: The SMS program is intended for individuals 18 years of age or older in the United States.
5. Intellectual Property
The Site and its content, including text, graphics, logos, videos, page designs, and software, are owned by Reflexion Digital or its licensors and are protected by copyright, trademark, and other intellectual-property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent. Ownership of client deliverables is governed by the applicable services agreement.
6. Client Materials
When clients provide materials (logos, footage, testimonials, patient-approved content, or other assets), the client represents that it has the rights and any required consents to use and share those materials, including compliance with applicable healthcare marketing and privacy requirements, and grants us a license to use them to perform the services.
7. Third-Party Services
Our services and the Site may reference or integrate third-party platforms (such as advertising networks, analytics, scheduling, or CRM tools). Those platforms are governed by their own terms and privacy policies, and we are not responsible for their acts, omissions, or availability.
8. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REFLEXION DIGITAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). LIABILITY RELATING TO PAID SERVICES IS GOVERNED BY THE APPLICABLE SERVICES AGREEMENT.
10. Indemnification
You agree to indemnify and hold harmless Reflexion Digital and its officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or violation of these Terms.
11. Termination
We may suspend or terminate access to the Site at any time for conduct that violates these Terms or is otherwise harmful. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) survive.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Fresno County, California, and you consent to their jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
